The Process
How the review process works
A clear, transparent path from a 60-second questionnaire to speaking with an independent law firm. Free, confidential, no obligation.
Check if you may qualify
Answer a short set of questions on the litigation page. It takes about 60 seconds and there is no cost or obligation.
Speak with a case specialist
If your answers meet initial criteria, a case specialist will call to confirm the details. The call is free and private.
A law firm reviews your claim
An independent, participating law firm reviews your information and explains your options. They work on a contingency basis.
Deadlines matter
Every claim has a filing deadline, called a statute of limitations. These deadlines vary by state and injury, and can be as short as one to two years from diagnosis or discovery.
Waiting can permanently bar a claim, even when the injury is clearly related to the product.
What to have ready
You do not need to gather anything to start. The specialist can help you find whatever is missing. If you have some of these details ready, things move faster:
- ✓Approximate dates you used the product or received the treatment
- ✓Date and type of diagnosis or injury
- ✓Name of the prescribing doctor, clinic, or hospital
- ✓Product or brand name (and lot number, if you have it)
- ✓A phone number and email where a case specialist can reach you
If the injured person has passed away, a surviving spouse, adult child, or the personal representative of the estate can start the review on their behalf.
What a case review costs
$0
The case review is free. Participating law firms work on a contingency basis. The firm advances all case costs (medical record retrieval, expert reviews, filing fees) and only gets paid a percentage if compensation is recovered.
If no compensation is recovered, you owe nothing. Not the fee, and not the costs.
Filing does not affect your care
A product liability claim does not change your treatment plan and does not affect your health insurance coverage. Do not stop or change any medication without talking to your doctor.
What we are and what we are not
LegalWisdom is a legal advertising service. We are not a law firm and we do not give legal or medical advice. An attorney-client relationship only exists once you sign directly with a law firm.
Eligibility
Who a case review is for
Eligibility depends on the specific litigation. In general:
You may qualify if
- ✓You (or a family member) used the product or received the treatment
- ✓You were diagnosed with, or experienced, a related injury
- ✓The diagnosis or injury happened within the window that specific litigation covers
- ✓You have not already settled a claim for the same injury
This is probably not for you if
- ✕The injury occurred before the product was on the market
- ✕You are already represented by an attorney for this matter
- ✕You are looking for medical advice. Please talk to your doctor first.
- ✕You are outside the United States (participating firms represent U.S. claimants)
